Terms of Service
These Terms of Service (“Terms”) govern access to and use of the websites, mobile apps, and education-platform services operated by HaBilkul (legal name: HEMANT SINGH, proprietorship, India) (“HaBilkul”, “we”, “us”). By using the Services, you agree to these Terms.
1. Who may use the Services
You must be able to form a binding contract under applicable law. If you use the Services on behalf of an academy or organisation, you confirm you have authority to bind that organisation. If you are a minor, you may use the Services only under the supervision of a parent, guardian, or authorised academy administrator as required by law.
2. Accounts and organisations
- You are responsible for account credentials and for activity under your account.
- Organisation admins control who can access their tenant, courses, and learner data.
- You must provide accurate information and keep it up to date.
3. Acceptable use
You agree not to:
- Break any applicable law or third-party right
- Upload unlawful, harmful, or infringing content
- Attempt to access systems or data without authorisation
- Interfere with or disrupt the Services
- Misrepresent your identity or affiliation
- Use the Services to spam or harass others
We may suspend or terminate access if we reasonably believe these Terms have been violated.
4. Content and licences
Academies and users retain ownership of content they upload, subject to rights granted to HaBilkul to host, display, and process that content as needed to operate the Services. HaBilkul and its licensors own the platform software, branding, and documentation. You may not copy, reverse engineer, or resell the platform except as allowed by law or a written agreement with us.
5. Third-party services
The Services may link to or integrate third-party tools (for example hosting, payments, or media). Those services have their own terms and privacy policies. HaBilkul is not responsible for third-party products outside our reasonable control.
6. Fees
Some features may be paid. Fees, billing cycles, and refunds (if any) will be described at purchase or in a separate commercial agreement with your organisation. Taxes may apply as required by Indian law.
7. Privacy
Our collection and use of personal information is described in the Privacy Policy.
8. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, HaBilkul disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
9. Limitation of liability
To the fullest extent permitted by law, HaBilkul will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the Services in the 12 months before the claim, or INR 5,000 if no fees were paid.
10. Indemnity
You agree to defend and indemnify HaBilkul against claims arising from your content, your misuse of the Services, or your breach of these Terms, except to the extent caused by our wilful misconduct.
11. Termination
You may stop using the Services at any time. We may suspend or end access if you breach these Terms or if we discontinue a product. On termination, your right to use the Services stops. Sections that by nature should survive will survive.
12. Changes
We may update these Terms. The “Last updated” date will change when we do. If you continue using the Services after changes take effect, you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of India. Courts in Ghaziabad / Uttar Pradesh (or as otherwise required by mandatory law) shall have jurisdiction, subject to applicable consumer protections.
